Q: I paid $135 application fee for a rental property

I paid $135 application fee for a rental property I submitted my application with all the documents they said that I was missing my husbands ID which I resent it with his ID attached they told me that they did not get it I sent it again two more time via email now they are telling me that I took too long to send his ID and that my application was denied and theyre keeping the 135 can they do that

A: Most likely yes. The application is a processing fee which gets charged whether you get a rental until or not. However, it would depend upon what the policy says in terms of the application fee and whether it was refundable or not. My guess is that the application fee is stated as being non refundable.

A: I agree with my colleague that they probably can keep the application fee, however it seems odd that a missing drivers license would hold up processing your rental application or giving you a conditional approval. Is the only reason your application was denied due to the delay? Normally the landlord just wants to verify that you have sufficient income to pay the rent, you haven't been evicted before and you are not a habitual offender of the law. They should be able to determine these things, even without a copy of a drivers license. You may want to review the application that you filled out to see exactly what the terms and conditions were. I would want to know how long the delay was from the time you submitted your application and the time they denied your application. If the application does not state that the license is required documentation or if it does not say there is a deadline to submit your information and the time in which you submitted everything was "reasonable" (ie a couple of days) then you may have a shot at getting your fee back. It would all depend upon what the application says. Best of Luck! Jennifer
